Terms And Conditions

CIMB CLICKS FOR CREDIT CARD

 

 TERMINOLOGY

  1. CIMB CLICKS FOR CREDIT CARD is special banking facility for Client User accessed through the internet networks using browser software in computers/other means.

  2. Bank is PT Bank CIMB Niaga Tbk based in South Jakarta, including the head office and branch offices as well as other offices being integral and inseparable part of PT Bank CIMB Niaga Tbk.

  3. Passcode is secret code to send by Bank through Short Messaging Services (SMS) to the Registered Telephone Number. The Passcode is needed by Client User to carry out registration and/or reactivate the Password of CIMB CLICKS FOR CREDIT CARD.

  4. Password is a set of unique digit consisting of letter and number which is confidential and only known by Client User and must be inputted by Client User upon using the CIMB CLICKS FOR CREDIT CARD service.

  5. Paycode is secret code in term of a set of number aimed as additional security sent by Bank to the Registered Telephone through a Short Messaging Services (SMS), in case Client User is to carry out Financial Transaction.

  6. Registered Telephone is the cellular telephone number of the Client User registered with the CIMB CLICKS FOR CREDIT CARD system.

  7. Transaction is any kind of access and/or transaction now is or in the future to be determined by the Bank to carry out using CIMB CLICKS FOR CREDIT CARD, including but not limited to:

    • Financial Transaction, namely transaction related with the use of Credit Card account as listed in the CIMB CLICKS FOR CREDIT CARD service ("Account") such as but not limited to bill payment and/or voucher purchase and/or conversion of transaction to installment and/or instant cash and/or other transactions with financial features ("Financial Transaction");
    • Non-Financial Transaction, such as but not limited to total bill information and/or credit card statement and/or installment information and/or transaction information not yet accepted into statement and/or other transactions carried out for administrative purposes or those not included in Financial Transaction ("Non-Financial Transaction");
    • Other Transaction that has been and/or to be determined by the Bank to be able to carry out through CIMB CLICKS FOR CREDIT CARD service.
  8. Client is individual not yet registered as CIMB CLICKS FOR CREDIT CARD user.

  9. Client User is Client already registered as CIMB CLICKS FOR CREDIT CARD user.

  10. Instant Cash is Financial Transaction in term of cash drawing made through CIMB CLICKS FOR CREDIT CARD in which the funds obtained are directly transferred to the account of the Bank or other banks by ATM networks in Indonesia.

  11. E-Statement is statement delivery service sent to email registered by Client User.

  12. Installment is a feature in which Client User may change the mechanism of payment of Financial Transaction into installments for specific period and at interest rate as determined by the Bank.

 

REGISTRATION OF CIMB CLICKS FOR CREDIT CARD

  1. Client may carry out registration of CIMB CLICKS FOR CREDIT CARD by completing the application on-line through the website of CIMB CLICKS or through ATM of CIMB Niaga.

  2. During registration, Client is required to enter the credit card number and complete other details required by the Bank.

  3. To carry out the registration of CIMB CLICKS FOR CREDIT CARD Client must use valid and active credit card.

  4. Client must have active Registered Telephone as a mean to send the Passcode.

  5. Client User must input the Passcode sent to the Registered Telephone as approval and validation of the registration of CIMB CLICKS FOR CREDIT CARD.

  6. Change of Registered Telephone number may be carried out by Client User through the Automated Teller Machine (ATM) or Phone Banking 14041.

  7. The procedures for changing the Registered Telephone number may only be carried out by Client User who meets the verification requirements set forth by the Bank.

  8. Client must read, understand and accept the Terms and Conditions of CIMB CLICKS FOR CREDIT CARD.

 

THE TERMS OF USE CIMB CLICKS FOR CREDIT CARD

  1. Client User may use CIMB CLICKS FOR CREDIT CARD to carry out Financial Transaction, Non-Financial Transaction as well as other transactions, as determined by the Bank now or in the future.

  2. In order to access CIMB CLICKS FOR CREDIT CARD service, Client User must input the Credit Card Number and Password that serve as the identity of Client User.

  3. For each Financial Transaction, Client User must complete all details required correctly and completely.

  4. Client User is obliged and responsible for ensuring the completeness and accuracy of transaction instruction. Bank shall not be responsible for any and all consequences arising from the negligence, incompleteness, inaccuracy or ambiguity of instruction by Client User.

  5. In any Financial Transaction, the system will always make confirmation of data inputted by Client User and send Paycode that serves as token/additional security. The Paycode is sent by the Bank system through Short Messaging Services (SMS) to Registered Telephone.

  6. Bank receives and performs all instructions from Client User as valid instructions based on the use of Password and Paycode. Bank has no obligation to study or investigate the authenticity or validity or authority of user of Password and Paycode or to evaluate, verify or substantiate the correctness or completeness of the instructions concerned, the instructions are, therefore, legal and binding to the Client User accordingly.

  7. Client User may not cancel Financial Transaction, as at the same time Bank promptly process such instructions.

  8. Bank shall be entitled not to perform the instructions from Client User if the Financial Transaction exceeds the transaction limit, where Bank finds out or has reasons to suspect fraud or crime has been or to be involved, or based on other discretion of Bank.

  9. For each instruction from Client User for Financial Transaction successfully done by Bank, Client User shall obtain evidence of transaction in term of reference number as evidence that such transaction has been done by Bank, and the evidence shall be saved in the database of Bank according to the regulations in force. In addition, Bank shall send notification containing the details of Financial Transaction carried out by Client User through media normally used by Bank ("Notification"). Client User accepts and acknowledges that the cause of transaction through CIMB CLICKS FOR CREDIT CARD, all instructions and communications from Client User received by Bank shall be treated as valid evidence while they are not in writing and or without the issuance of signed documents.

 

CONVERSION OF TRANSACTION INTO INSTALLMENT

  1. Transaction carried out by Client User other than Instant Cash and/or Cash Advance transaction may be converted into installment.

  2. Client User may apply for change of transaction into installment through CIMB CLICKS FOR CREDIT CARD service prior to such invoice is printed or billed to Client User (displayed in non-billed transaction information in CIMB CLICKS FOR CREDIT CARD).

  3. Client User may choose the period and the installment, and confirm the transaction by inputting the Paycode sent to the Registered Telephone of Client.

  4. The monthly installment charged constitutes rounded up of the Bank system.

  5. Transaction that can be converted into installment is transaction with minimum amount of Rp 500.000 (five hundred thousand rupiah). The amount is subject to change at any time according to the provisions of Bank.

  6. Bank shall process conversion of transaction into installment no later than on the following business day after the Client User has carried out the conversion transaction through CIMB CLICKS FOR CREDIT CARD.

  7. If following the conversion there are other transactions, in which the amount of transaction added by the conversion and interest upon the process of conversion exceeds the credit card limit, the conversion transaction shall be rejected by Bank.

  8. Transaction not yet successfully converted can be seen in CIMB CLICKS FOR CREDIT CARD.

  9. Bank shall be entitled to decline the application of Client User to convert his or her transaction into installment without necessarily specify the reasons for such refusal.

  10. Client User may call Phone Banking 14041 to obtain information whether the application for approval for transaction converted into installment is declined.

  11. The interest and period of conversion of transaction into installment shall be in accordance with the applicable provisions in Bank CIMB Niaga.

  12. Installment Transaction is not applicable for the holder of Corporate cards.

  13. By carrying out conversion of transaction into installment, Client User agrees with the interest rate, cost (if any) and the period chosen by Client User.

  14. The installment date shall be the same date as the date the transaction is converted into installment by Bank.

  15. Early settlement of installment shall be subject to charges in accordance with the terms and conditions applicable in Bank.

 

INSTANT CASH

  1. Instant Cash transactions may be carried out using the ATM CIMB Niaga networks or ATM networks determined by CIMB Niaga under limit cash advance owned by Client User.

  2. Instant Cash confirmation shall use Paycode to be inputted on the screen opened by Client User.

  3. Maximum limit per transfer transaction and per day shall be in accordance with the applicable terms and conditions.

  4. Each Instant Cash transaction shall be subject to cash advance costs and/or transfer fee according to the applicable terms and conditions.

  5. Each Instant Cash transaction carried out by Client User shall deduct the Cash Advance limit.

  6. Instant Cash transaction may not be converted into Installment.

  7. Any postponement in the repayment of Instant Cash transaction shall be subject to interest according to the applicable terms and conditions of Cash Advance.

  8. Any failure in inputting the destination account number and Instant Cash nominal values shall be the sole risk of Client User.

 

E-STATEMENT

  1. By carrying out registration of e-Statement:

    • CIMB Niaga Credit Card Statement shall be delivered according to the printing date of the invoice report only through the registered email address.
    • CIMB Niaga shall not make physical delivery of the statement of all CIMB Niaga Credit Card in the name of Client User, brochures, catalogues and other CIMB Niaga Credit Card product/service information through postal service or courier service. The information on CIMB Niaga Credit Card product/service can be further accessed through the website www.cimbniaga.com or www.creditcard.cimbclicks.co.id or Phone Banking 14041.

  2. Bank shall not be responsible and has no obligation to study, investigate the authenticity, validity or authority and accuracy and correctness of the email address of the recipient of e-Statement.

  3. The e-Statement service facility for additional card shall refer to the registered e-mail address of the main card.

  4. Any objection against inappropriate transaction in e-Statement shall be filed no later than 30 (thirty) days from the printing date of the credit card statement through Phone Banking 14041 or in writing by facsimile sent to CIMB Niaga Card Center at (021) 7486 7900.

  5. If Client User does not receive e-Statement or the e-Statement received is truncated, he or she may contact Phone Banking 14041.

  6. The delivery of e-Statement shall be effective on the same month if the registration of e-Statement is accepted by Bank at least 3 (three) business days prior to the printing date of credit card statement.

  7. The e-Statement service shall be terminated when CIMB Niaga Credit Card is closed at the request of the Holder of Main Card, or at the discretion of Bank CIMB Niaga with or without prior notice to the Holder of Main Card.

  8. Client User must promptly inform Bank in the event of change of email address for the purpose of delivery of e-Statement. In case the Client User is negligent and/or fails to notify such change of e-mail address, Client User hereby indemnifies Bank from any claim against non-delivery of e-Statement to the new email address of Client User.

  9. Bank shall not be responsible for any failure/system failure despite precautionary measures according to commercial standard applicable in banking industry.

 

PASSWORD, PASSCODE, PAYCODE AND OBLIGATIONS OF CLIENT USER

  1. Password, Passcode and Paycode are secret codes in which the authority to use and manage rest on Client User.

  2. Client User must ensure that the use of CIMB CLICKS FOR CREDIT CARD is always carried out under full supervision of Client User and where Client User leaves the terminal in active condition (logged in), the Bank system shall, after a specific period, automatically terminate the access to CIMB CLICKS FOR CREDIT CARD, in order to prevent abuse by unauthorized party.

  3. Client User must secure the Password, Passcode and Paycode by:

    • Not informing the Password, Passcode, and Paycode to any other party including family, friend or Phone Banking Agent as well as Bank employees for any purpose.
    • Not written down the Password, Passcode and Paycode on the table, terminal or save them in any written form or in computer applications or other storage media that allow discovery or identification by other people.
    • The Password, Passcode and Paycode must be used carefully to avoid identification by other party.
    • Changing the CIMB CLICKS FOR CREDIT CARD Password periodically and not making them of in the form of letter and number easily identified by other party and other ways in order to ensure that the Password, Passcode and Paycode are not abused by unauthorized party.

  4. Client User may reactivate blocked Password by resetting the Password through CIMB CLICKS FOR CREDIT CARD service.

  5. To reset the Password, Client User must enter the Credit Card Number and complete other data required by Bank, and input the Passcode.

  6. Client User shall be solely responsible for the security and confidentiality of the Password, Passcode and Paycode and for all Transaction instructions made based on the use of Password, Passcode and Paycode owned by Client User, any form of Password, Passcode and Paycode abuse shall, therefore, be the responsibility of Client User and Client User shall hold the Bank free from any form of responsibility or claim, either by other party or Client User due to the Password, Passcode or Paycode abuse by any other third party.

  7. Client User must immediately report to Bank when Password, Passcode, and Paycode is identified/allegedly identified by other party. Upon such notification, Client User agrees that Bank will immediately perform blocking so that Client User cannot use CIMB CLICKS FOR CREDIT CARD. Any notification from Client User submitted through the branches or Phone Banking 14041 service must be confirmed by written notification in the form and substance acceptable to Bank. All transaction instructions based on the use of Password, Passcode and Paycode that occur prior to the receipt of report by the authorized officer of Bank shall be the sole responsibility of Client User.

  8. The use of Password, Passcode and Paycode shall have equal force of law as written instruction signed by Client User, therefore Client User hereby represents that the use of Password, Passcode and Paycode in any Transaction instruction through CIMB CLICKS FOR CREDIT CARD constitutes authorization by Client User to Bank to perform the Transaction including and not limited to charging the Transaction fee, now exist and or to be determined later by Bank.

 

FEES & AUTHORITY TO DEBIT ACCOUNT

  1. Client User hereby authorizes Bank to debit the credit card account of Client User with Bank for the amount of :

    • Financial Transaction according to the instruction from Client User to Bank through CIMB CLICKS FOR CREDIT CARD facility; and/or
    • Fees including Transaction fee for the use of CIMB CLICKS FOR CREDIT CARD facility (including and not limited to instant cash fee) and/or transfer fee in instant cash transaction.

  2. For any Passcode and Paycode, Client User shall be charged Short Messaging Services (SMS) by respective cellular telephone operator of which the rate shall be in accordance with the applicable tariff of the respective operator.

  3. Client User agrees that Bank is, at its discretion, allowed to change, add or draw the fees charged on Client User for the use of CIMB CLICKS FOR CREDIT CARD facility, which change shall be informed by Bank to Client User through media of information normally used by Bank.

  4. This authority shall be terminated if Client User terminates the use of CIMB CLICKS FOR CREDIT CARD service and all obligations of Client User to Bank have been fulfilled.

 

TERMINATION OF CIMB CLICKS FOR CREDIT CARD SERVICE

  1. Client User agrees that Bank is entitled to terminate at any time all or part of service existing in CIMB CLICKS FOR CREDIT CARD system temporarily or for a specific period as determined by Bank, including but not limited to in case:

    • There is obligation for Bank to implement the provisions of legislations in force;
    • According to the discretion of Bank there is indication of abuse of CIMB CLICKS FOR CREDIT CARD or other violation of laws;
    • There is system disruption that cause Bank to decide to terminate part or all of services in CIMB CLICKS FOR CREDIT CARD;
    • For the purpose of novation, maintenance or other purposes due to any reasons considered favorable by Bank, and Bank shall, therefore, not be held liable to be responsible to any party.

  2. Upon such termination, Bank shall deliver notification to Client User through media of information/announcement normally used by Bank for such purpose, or banking electronic media easily accessible by Client User.

  3. CIMB CLICKS FOR CREDIT CARD service shall be terminated if:

    • Client User closes the credit card at the request of Client User him/herself;
    • There is written report from Client User received by Bank on the alleged identification or identification of Password, Passcode and Paycode by any unauthorized party;
    • There is request from Client User to Bank to terminate CIMB CLICKS FOR CREDIT CARD service either in writing or through ATM of CIMB Niaga.

  4. Regarding the termination of the service, Client User agrees to indemnify Bank from any claim or loss that may arise from such termination and/or suspension of all or parts of the menu in CIMB CLICKS FOR CREDIT CARD.

 

THINGS TO CONSIDER

  1. For any expired credit card, Client User cannot carryout Financial Transaction.

  2. If credit card of Client User expires and extended using different Credit Card Number from the previous one, the Client User concerned cannot carry out Financial Transaction through CIMB CLICKS FOR CREDIT CARD. If Client User wants to stay using CIMB CLICKS FOR CREDIT CARD service for the extended credit card, Client User should carry out re-registration for the extended credit card.

  3. The validity and legality of data inputted with respect to transactions shall be the sole responsibility of Client User.

  4. Client User shall be responsible and obliged to immediately report to Bank in the event of:

    • Duplication of system used for the purpose of transaction; or
    • Use and/or change by unauthorized party.

  5. All risks that may arise as the result of the negligence and/or abuse and/or disruption with respect to transaction shall be the sole responsibility of Client User. Client User hereby indemnifies Bank from any claim that may arise from other party or Client User as the result of negligence and/or abuse and/or disruption with respect to transaction, such as but not limited to abuse and/or disruption as the result of:

    • Authorizing transaction through CIMB CLICKS FOR CREDIT CARD to any other third parry;
    • Mistake in completing data related with transaction;
    • Negligence/fault in following the instruction, procedures and directives of use related with transaction;
    • Virus attack on the relevant system or network used for the purpose of transaction;
    • Any failure of hardware and software of cellular operator or other relevant media used for transaction.

 

FORCE MAJEURE

Client User shall indemnify Bank from any claim, in case Bank fails to perform instruction from Client User either in parts or as a whole due to events or causes beyond the reasonable control or capability of Bank, including but not limited to disaster, war, riots, equipment condition, malfunction system or transmission, electrical failure, telecommunication breakdown, government policy, and other events or causes beyond the reasonable control or capability of Bank.

 

COMPLAINT/GRIEVANCE HANDLING

  1. In the event of question and/or complaint/grievance related to the transaction made, Client User may file complaint either in writing to the branches of Bank and/or verbally through Phone Banking 14041 by fulfilling the requirements and procedures of complaint set forth by Bank.

  2. Complaint or dispute may only be filed within maximum 7 (seven) business days from the date of transaction.

  3. Bank shall carry out inspection/investigation with respect to complaint by Client User according to the applicable policies and procedures in Bank.

 

MISCELLANEOUS

  1. Bank shall be entitled to modify at any time parts or all of the provisions in these Terms and Conditions of CIMB CLICKS FOR CREDIT CARD by notifying Client User in the form of and through media normally used by Bank. These Terms and Conditions of CIMB CLICKS FOR CREDIT CARD form integral and inseparable part of the Application for Credit Card and CIMB CLICKS and the General Terms and Conditions of Account Opening signed by Client User.

  2. Client User is subject to the provisions and regulations in force in Bank and all services or facilities and all transactions covered by CIMB CLICKS FOR CREDIT CARD, including any of the modifications are to be notified in advance by Bank through media normally used by Bank. By using CIMB CLICKS FOR CREDIT CARD and accepting these Terms and Conditions of CIMB CLICKS FOR CREDIT CARD, Client User binds him/herself to all Terms and Conditions of CIMB CLICKS FOR CREDIT CARD and represents that Bank has given adequate explanation on the characteristics of CIMB CLICKS FOR CREDIT CARD to utilize by Client User and Client User has understood all consequences of such utilization of CIMB CLICKS FOR CREDIT CARD, including the benefits, risks and costs inherent with CIMB CLICKS FOR CREDIT CARD.

  3. In the event of dispute, Client User agrees to settle it amicably by discussion to reach agreement, failing of which Bank and Client User agree to choose permanent and general legal domicile at South Jakarta District Court in Jakarta. The same shall not prejudiced to the rights and authorities of Bank to file claim/lawsuit before other courts within the territory of the Republic of Indonesia.
